Photo by Kevin Bain\/The University of Mississippi Marketing Communications<\/p><\/div>\n<p><span data-contrast=\"none\">OXFORD, Miss. \u2013 U.S. Supreme Court Justice Neil Gorsuch referenced the work of <\/span><a href=\"http:\/\/olemiss.edu\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-contrast=\"none\">University of Mississippi<\/span><\/a> <a href=\"http:\/\/law.olemiss.edu\/\"><span data-contrast=\"none\">law<\/span><\/a><span data-contrast=\"none\"> professor Chris Green multiple times in a recent ruling.&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"none\">In <\/span><a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/21-376_7l48.pdf\"><span data-contrast=\"none\">Haaland v. Brackeen<\/span><\/a><span data-contrast=\"none\">, justices voted 7-to-2 to uphold the power of the <\/span><a href=\"https:\/\/www.congress.gov\/bill\/95th-congress\/senate-bill\/1214\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-contrast=\"none\">1978 Indian Child Welfare Act<\/span><\/a><span data-contrast=\"none\">, which in part provides that if Native American children are removed from a dangerous or unfit home, a preference is to be given to transferring custody to a member of a Native American tribe. The litigants in part challenged the federal government\u2019s authority to make such a determination.&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"none\">Green, who holds the Jamie L. Whitten Chair of Law and Government, recently published an article in the Penn State Law Review entitled <\/span><a href=\"https:\/\/www.pennstatelawreview.org\/print-issues\/tribes-nations-states-our-three-commerce-powers\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-contrast=\"none\">\u201cTribes, Nations, States: Our Three Commerce Powers,\u201d<\/span><\/a><span data-contrast=\"none\"> in which he researched the original meaning of Congress&#8217;s power over commerce.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"none\">Green&#8217;s article highlighted the federal government&#8217;s power to govern relationships with tribes as groups of individuals and as <\/span><a href=\"https:\/\/www.ncai.org\/policy-issues\/tribal-governance\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-contrast=\"none\">sovereign governments<\/span><\/a><span data-contrast=\"none\">. The article gave particular attention to <\/span><a href=\"https:\/\/tile.loc.gov\/storage-services\/service\/ll\/usrep\/usrep070\/usrep070407\/usrep070407.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-contrast=\"none\">a Supreme Court case from 1866<\/span><\/a><span data-contrast=\"none\"> and early correspondence about the commerce powers between George Washington and his first Attorney General, Edmund Randolph, which both Justice Gorsuch and Justice Clarence Thomas discussed in their opinions.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"none\">Gorsuch referenced Green\u2019s article three times in his concurrence with the majority opinion.&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"none\">\u201cThe past is relevant; the past has a lot of details,\u201d Green said. \u201cAll this historical stuff we&#8217;re digging into, it matters and it\u2019s encouraging to know that it matters to the Supreme Court.\u201d&nbsp;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"none\">This is not the first time the Supreme Court has referenced Green\u2019s research, said Ron Rychlak, distinguished professor of law and a fellow Jamie L.
