{"id":653,"date":"2008-04-23T11:38:52","date_gmt":"2008-04-23T16:38:52","guid":{"rendered":"http:\/\/ezing.me\/transfer\/?p=653"},"modified":"2014-09-23T09:24:34","modified_gmt":"2014-09-23T14:24:34","slug":"court-of-appeals-to-hold-special-session-at-ole-miss-law-school","status":"publish","type":"post","link":"https:\/\/web20.olemiss.edu\/news\/wordpress\/court-of-appeals-to-hold-special-session-at-ole-miss-law-school\/","title":{"rendered":"Court of Appeals to Hold Special Session at Ole Miss Law School"},"content":{"rendered":"<p>\n<span>OXFORD, Miss. &#8211; For the fourth consecutive year, the Court<br \/>\nof Appeals of Mississippi plans to move its proceedings to<br \/>\nthe University of Mississippi School of Law for a special<br \/>\nsession in which law students have the unique opportunity<br \/>\nto deliver oral arguments in cases pending before the<br \/>\ncourt.<br \/>\n<\/span>\n<\/p>\n<p><!--more--><\/p>\n<p>\n<span>The court convenes at 1:30 p.m. Tuesday (April 22) in the<br \/>\nWilliam N. Ethridge Jr. Moot Court Room on the third floor<br \/>\nof the Lamar Law Center. The three-judge panel plans to<br \/>\nallow law students to participate in a brief<br \/>\nquestion-and-answer session after hearing two cases<br \/>\npresented by third-year law students enrolled in the law<br \/>\nschool&#8217;s Criminal Appeals Clinic.<br \/>\n<\/span>\n<\/p>\n<p>\n<span>The proceedings are open to the public and all UM students<br \/>\nare encouraged to attend, especially those with an interest<br \/>\nin attending law school. The special session is to be<br \/>\nconducted with full security search requirements, and no<br \/>\nexit and re-entry will be allowed. Cell phones are not<br \/>\nallowed in the courtroom.<br \/>\n<\/span>\n<\/p>\n<p>\n<span>Arrival by 12:30 p.m. is strongly encouraged to ensure that<br \/>\neveryone can be seated before court is called to order.<br \/>\nOverflow seating is to be available in Moot Court Room II.<br \/>\n<\/span>\n<\/p>\n<p>\n<span>&#8220;Statistically, since 2002, the Criminal Appeals Clinic has<br \/>\nrepresented 34 indigent defendants in criminal appeals<br \/>\nbefore the Mississippi Supreme Court and the Court of<br \/>\nAppeals,&#8221; said Phillip W. Broadhead, clinical professor of<br \/>\nlaw and director of the Criminal Appeals Program. &#8220;Both the<br \/>\nCourt of Appeals and the state Supreme Court have been very<br \/>\nsupportive of the Criminal Appeals Program.&#8221;<br \/>\n<\/span>\n<\/p>\n<p>\n<span>The program, created in 2002 as part of UM&#8217;s National<br \/>\nCenter for Justice and the Rule of Law, is designed to give<br \/>\nthird-year students practical experience in criminal law<br \/>\nand procedure in the pro bono representation of indigent<br \/>\npersons in cases pending before the state appellate<br \/>\ncourts.<br \/>\n<\/span>\n<\/p>\n<p>\n<span>Through the program, students research, write and file a<br \/>\nbrief on an assigned case pending before the court. If the<br \/>\ncourt agrees to hear oral arguments in a pending case, two<br \/>\nCriminal Appeals Clinic students are chosen to argue the<br \/>\ncase before a panel of three judges, Broadhead said.<br \/>\n<\/span>\n<\/p>\n<p>\n<span>This year, students are to argue cases that originated in<br \/>\nRankin and Oktibbeha counties. Students Angela M. Gallagher<br \/>\nof Magnolia and Jay Hurdle of Memphis are presenting oral<br \/>\narguments in the case of Luckett v. State, which involves<br \/>\nan embezzlement conviction. Students William Andrew Lewis<br \/>\nof Fayetteville, Ga., and Daniel B. McLeroy of Center,<br \/>\nTexas, are to present arguments in the case of Brooks v.<br \/>\nState which involves a conviction on two charges of<br \/>\naggravated assault on a police officer.<br \/>\n<\/span>\n<\/p>\n<p>\n<span>The students are allowed to be appointed as special counsel<br \/>\nin the cases by order of the state appellate courts under<br \/>\nthe Mississippi Limited Practice Act, which permits<br \/>\nthird-year law students to be admitted to the Bar under the<br \/>\noversight and supervision of a clinical professor who also<br \/>\nis a licensed, practicing Mississippi attorney. Since the<br \/>\nprogram began in 2002, 86 students have received training<br \/>\nin the highly specialized field area of appellate practice,<br \/>\nBroadhead said.<br \/>\n<\/span>\n<\/p>\n<p>\n<span>&#8220;One of the features of the Criminal Appeals Program&#8217;s<br \/>\nteaching goals is to expose the students not only to the<br \/>\nart of brief writing and the skills of legal research, but<br \/>\nalso to general trial practice,&#8221;
